By downloading, installing, or using Kicked ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Kicked is a habit tracking application designed to help users break bad habits and track their progress. The App provides tools for streak tracking, journaling, milestone sharing, and motivational support.

3. Medical Disclaimer

Kicked is not a medical application. The App is designed for general wellness and habit tracking purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

4. User Accounts

You may use Kicked without creating an account. If you choose to create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. Subscriptions and Payments

Kicked offers optional premium subscriptions with the following terms:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

6. User Content

You retain ownership of any content you create within the App (journal entries, custom habit names, etc.). By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the service.

7. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or decompile the App
• Share your account with others

8. Intellectual Property

The App, including its design, features, and content, is owned by Kicked and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Kicked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

The App is provided "as is" without warranties of any kind, either express or implied.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, with or without notice.

You may terminate your account at any time by deleting your account from the Settings screen.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
